• Participant – The Gilpin Customer who is participating in the Gilpin Rewards Programme
  • Programme – Gilpin Rewards Programme
  • Promoter – Gilpin Ltd
  • Points and / or Recognition Points – the points earned by the Participant under the Programme and which may be redeemed for rewards offered under the Programme
  • Programme Account – The programme account at Gilpin Ltd opened for a Participant for the sole purpose of accruing points and redeeming rewards
  • Trading Account – The trading/credit account of the Participant held with Gilpin Ltd
  • Programme Website – www.gilpinrewards.co.nz
  • The singular includes the plural and vice versa
The completion of an online registration form for the Gilpin Programme by a Participant constitutes agreement by that Participant to these terms and conditions and their application to the Programme.
  • Only Trade Customers of the Promoter who have a valid and active Trading Account are eligible to apply to register for the Programme. Eligibility as a Trade Customer is determined by the Promoter (in its sole discretion).
  • Participation in the Programme is by invitation only and a completed registration form is subject to acceptance by the Promoter (in its sole discretion).
  • Participation in the Programme will commence from the time the registration has been accepted by the Promoter.
  • Staff of the Promoter or Gilpin Performance are not eligible to participate in the Programme.
  • The Programme commenced on 1st October 2017. 
  • The Programme operates on a yearly validity period starting on 01 April each year. Continuation of the Participant’s involvement in the Programme will be subject to online re-registration (accepting terms and conditions and updating Participant details etc.) and acceptance of that re-registration by the Promoter within three months of 01 April each year (or, at the sole discretion of the Promoter, sometime after that date).
  • Points will be earned from the date the registration has been accepted by the Promoter (or from 01 April in each year at the sole discretion of the Promoter) and continue through to the next yearly validity period start date.
  • Participants in the Programme will earn points at a rate of 01 point for every $100.00 net spent on the purchase of goods through the Participant’s Trading Account. All purchase dollar values exclude GST.
  • Participants may earn extra points by achieving target purchase plans agreed with the Promoter.
  • The Promoter may from time to time run promotions which will allow Participants to obtain recognition points.
  • Points earned in the Programme are the property of the Participant (the Trading Account holder named in the relevant Programme registration form) and are not transferable to any other person, entity or Programme Account unless agreed in writing by the Promoter.
  • Appropriate deductions will be made to the points earned in the Programme by a Participant where purchased goods are returned for credit.
  • Appropriate adjustments will be made to the points earned in the Programme by a Participant where necessary to reflect any correction by the Promoter of a billing error.
  • The Promoter has no responsibility or liability to a Participant where goods are not available for purchase from the Promoter for any reason and this means that a Participant is not able to earn points on a desired purchase.
  • Points earned in the Programme from 01 October 2017 onwards will, if not redeemed beforehand, expire on the date that is three years after the end of the month in which the points were credited to the Programme Account of the Participant and will be deducted from the points balance in the Participant’s Programme Account.
  • If a Participant closes its Trading Account with the Promoter and the account is fully paid, then it will have until the end of the current yearly validity period of the Programme to redeem its points. Points still remaining in the Programme Account after that 31 March date will expire.
  • Participants are required to hold an active Trading Account with the Promoter and comply with the terms and conditions of that account. If a Participant maintains a Trading Account with the Promoter but the account is inactive for a period of 12 months, then the points in the Programme Account of the Participant will expire at the end of that 12 month period of inactivity. Failure by the Participant to comply with the terms and conditions (including agreed payment terms) of its Trading Account may, at the sole discretion of the Promoter, result in the cancellation of all points held by that Participant and/or the forfeiture of all rewards claimed but not yet delivered.
  • The rewards available in the Programme at any time are set out on the Programme Website (www.gilpinrewards.co.nz). These rewards and related points values may vary from time to time as (among other things) product models change and travel packages become available or expire.
  • A Participant must earn 100 points or more to be eligible to claim its first reward. Once the 100 points threshold has been reached, rewards may be claimed to any value to which the Participant is entitled.
  • A Participant may only claim a reward if it has sufficient points for the reward being claimed.
  • A Participant may only claim and may only receive a reward if its Trading Account is operating within the payment terms then agreed between the Participant and the Promoter.
  • Rewards are issued to and are the property of the Participant (the Trading Account holder named in the relevant Programme registration form).
  • The number of points used for a reward claim will be deducted from the points balance of the Participant’s Programme Account with the oldest points being deducted first.
  • A reward claim, to be valid, must contain a nomination of a person to whom the reward is to be delivered if the reward cannot be delivered to the Participant. The reward remains the property of the Participant.
  • All rewards are subject to availability and the Promoter (at its sole discretion) may substitute any reward offered as available on the Programme Website with a similar reward of approximately the same value and similar features.
  • No cash buy-in or cash part payment from a Participant for rewards will be permitted other than with the prior approval of the Promoter, in its sole discretion.
  • All rewards are subject to the specific conditions on which the provider of the reward makes the reward available. If there is any inconsistency between them and these terms and conditions, the specific conditions prevail.
  • Any dispute concerning rewards received under the Programme will be settled between the Participant and the supply merchant. The Promoter will endeavour to assist the Participant with the dispute but take no responsibility for resolving such disputes or for the dispute itself.
  • Rewards received by Participants are supplied to the Participant by the manufacturer, supplier or agent and come with the manufacturer’s or supplier’s or agent’s guarantee or warranty (if any) only and no further guarantee or warranty is provided by the Promoter. No claim for refund of points or any other form of compensation may be made on the Promoter in the event of any rewards returns, faulty rewards or unsatisfactory service affecting the Participant.
  • The Promoter is not responsible for lost or stolen rewards, including rewards lost or stolen during the course of delivery.
  • The Promoter accept no liability or responsibility for damage or loss to persons or property caused directly or indirectly by any reward received under the Gilpin Rewards Programme.
  • The Promoter is not responsible if a Participant cannot claim or redeem a reward for reasons beyond the Promoter’s reasonable control including the failure of a reward supplier to honour its obligations for any reason. However in these circumstances, where a Participant’s points have not been redeemed, the Participant may claim an alternative available reward.
  • Rewards cannot be exchanged for other rewards and are not refundable, replaceable or transferable for cash or credit under any circumstances. Nor can reward redemptions be cancelled or changed once they have been made.
  • The Promoter will endeavour to meet requests to redeem rewards that are not illustrated in the Programme Website catalogue. Rewards which are not illustrated in the Programme Website catalogue are provided at a further cost (in points) beyond the nominal cost of the reward. In some cases the RRP will be used, in other cases an uplift of at least 10% of points will be applied.
  • No cash payment will be made for any unredeemed points in any circumstances.
  • Generally, please allow up to 14 days for processing and delivery of rewards. Sometimes, due to seasonal demands, high volume or delays (among other things), processing and delivery may take longer than this.
  • Due to suppliers’ Christmas break any rewards a Participant wishes to have delivered before Christmas must be requested prior to 09 December. There will be no reward deliveries between 23 December and 15 January each year.
  • Participants will have access to Gilpin Rewards Program Prepaid VISA Gift Cards as a reward option. These cards are issued subject to the terms and conditions that accompany the card. By signing the card, activating the card or using the card, the Participant agrees to these card terms and conditions.
  • Gilpin Rewards Program Prepaid Visa Gift Cards will expire 12 months after the date of card issue.
  • VIP Participants will have access to a Gilpin Rewards Program Reloadable VISA Card as a reward option. These cards are issued subject to the terms and conditions that accompany the card. By signing the card, activating the card or using the card, the Participant agrees to these card terms and conditions.
  • Points may be redeemed by the Participant and funds loaded to the card subject to the terms and conditions of the Gilpin Rewards Programme.
  • Gilpin Rewards Program Reloadable VISA Cards will expire 24 months after the date of card issue.
  • Before expiry, and upon approval of the Promoter, a new card may be redeemed and the remaining balance allocated to the new card.
  • Eligibility to be a VIP Participant is at the sole discretion of the Promoter.
  • The Promoter may terminate a Participant’s participation in the Programme without notice for any reason including, without limitation, if the Participant:
    • fails to comply with these Programme terms and conditions;
    • abuses any privilege accorded to the Participants under the Programme;
    • supplies any misleading information or makes any misrepresentations to the Promoter in connection with the Programme;
    • becomes bankrupt or, if the Participant is a company, becomes insolvent, goes into receivership or liquidation or is sold.
  • If a Participant’s participation in the Programme is terminated under the above condition, then any points held by the Participant may, at the sole discretion of the Promoter, be cancelled.
  • A Participant may terminate their participation in the Programme at any time by giving written notice to the Promoter.
  • The Promoter may suspend or terminate the Programme at any time at its sole discretion without prior notice. At the termination of the Programme, any unredeemed points become the property of the Promoter. The Promoter will not be liable for any loss or claim arising from the suspension or termination of the Programme including (without limitation) any claim for a points balance in a Participant’s Programme Account at the time of suspension or termination of the Programme.
  • A complete Privacy and Collection Statement can be viewed on the Programme Website (www.gilpinrewards.co.nz) the first time Participants “Log in”. This statement sets out policies on management of Participants’ personal details, if any. In accordance with the Privacy Act, Participants can access personal information about them held by the Promoter and advise if they believe it is inaccurate, incomplete or out of date by contacting the Promoter.
  • By registering into the Programme Participants authorise the Promoter to seek access to, collect and use information about them for the purposes of marketing, planning, development and administration of the Programme.
  • Participants are solely responsible for any tax, duty or other charge imposed by law in relation to the Participants involvement in the Programme, any points earned or redeemed by the Participant or any other transaction of the Participant within the Programme. Participants should seek advice from their own taxation adviser or accountant.
  • The decision of the Promoter in all matters relating to the interpretation and the application of these terms and conditions will be final and binding on all applicants and registered Participants. No correspondence will be entered into.
  • The Promoter may change these terms and conditions at any time without notice and any changes take effect from the date on which it is uploaded to the Programme Website.
  • Changes may include (but not be limited to) changes to:
    • the rewards available;
    • the way Participants earn points;
    • the way Participants can redeem points;
    • the number of points required to obtain a reward; or
    • the number of points awarded and point conversion rates.
  • Any of these changes may be made even if they affect points Participants have already earned.
